Bills could change landscape of casino gaming in New Jersey in 2026

Legislation held over from 2025 could restrict advertising for gaming opportunities and allow horse racing tracks to expand their offerings in New Jersey.

A pair of bills and a potential amendment to the New Jersey Constitution could impact gaming in the state for 2026. Bills aim to restructure gaming advertising in NJ

Legislation that could modify current statutes for marketing the best online casinos in New Jersey consists of S1444 and S2356. Sen. Joseph P. Cryan brought forward S1444 while Sen. Shirley Turner introduced S2356.

Both bills are now with committees. S2356 would mandate that the New Jersey Division of Gaming Enforcement (NJDGE) perform a study of gaming advertisements to refine requirements for responsible gaming messaging in such marketing materials. The bill also gives the NJDGE the authority to ban gaming advertisements near schools or marketing that targets specific populations.

S1444 would also give the NJDGE new powers. The language of that bill would allow the NJDGE more authority in banning advertisements from NJ online casinos that the division considers deceptive or inappropriate.

Another bill could have the impact of giving New Jerseyans more choices in where to play in person.

The Meadowlands could expand play options under amendment

A resolution in the New Jersey Senate, SCR31, could give people in NJ another place to play physical slots. The Meadowlands is among the primary targets for the potential amendment to New Jersey's constitution.

If the resolution is approved by the legislature and voters, lawmakers in Trenton could authorize The Meadowlands to offer slot gaming. Under the tenets of the amendment, the resulting tax revenue would go toward pensions for public employees and improvements in Atlantic City, among other uses.

While The Meadowlands would represent competition for casinos in Atlantic City in that way, the new slots would also give New Jerseyans near the New York border options to play in their state instead of patronizing the future downstate New York casinos.
