May 8--MIAMI -- A lawsuit filed by luxury auto dealer Norman Braman challenging a plan to finance a Florida Marlins ballpark will go forward after a judge chose Thursday not to dismiss complaints that the plan is unconstitutional and misappropriates voter-approved bond funding.

The home run is such a cheap commodity at Great American Ballpark that even though the Marlins hit three of them -- enough usually to assure a win -- the result Monday was an 8-7 setback to the Cincinnati Reds.

It was less than a year ago the Marlins had a deal in place to acquire the left-handed hitting Jacque Jones from the Cubs. Apparently, the Marlins' front office was so overwhelmed with questions about the outfielder that it felt compelled to issue a blanket no-comment through the media relations staff. The Sun-Sentinel reports that it was peculiar, because rarely do the Marlins confirm or deny interest in anybody. (updated: 05/07/2008)
