I am not a police officer.  I'm not a police officer hater.  I'm just looking at the facts of the story.  It seems to me that if the police officer didn't follow police protcal, he is at fault.  Everyone laughs at reruns of Andy Griffith's show when Barney Fife oversteps his authority.  On TV no tradegy happens, all is good in the end.  In real life, officers who are overzealous are dangerous.

It does seem strange that a man who was driving drunk is considered the 'victim' here.  However, If the policeman was overstepping his authority, the PD is at fault.

Foley has already plead guilty to the DUI charge, and I hope they throw the book at him.  And you are so right about the bigger picture ... It's not at all funny when Barney Fife attempts murder.

You are correct Donutoly14, anyone who is armed and out of control, is dangerous.  I wonder how the media would tell this story if it was a rookie officer who was Black,  shot a drunk, CEO who was white?. Or what they would say if Foley had been armed, and shot back?. What a sad crazy world we live in.  Can anyone honestly say that if a person in a car pulled up, and started demanding them to pull over, that they would pull over, stop, and see what the person wanted. I can only speak for me, but I would have driven home, got the shotgun, and defended myself, And if I found out later that he was a police officer, who had failed to Identify himself, then I would feel horrible, But I wouldn't feel guilty.  Hell, in texas if someone brandishes a weapon at you, you can kill them, no questions asked, Unless they are a properly identified peace officer.  They might even give you a medal, if you shoot them more then once.

My father and step father are retired law enforcement and I agree, it seems that today more than ever police are constantly overstepping their authority, and good citizens are getting the brunt of it..not the people who need to be i.e. drug dealers, murderers, pedophiles, and rapists...stop putting people in the currupt "more money more justice"  legal system, and quit letting these people out of jail time and time again who really deserve to be behind bars. Its seems to me this cop was only looking to fill his quota and make a name for himself. Shame on him.

The officer should have waited for back up. He should be thrown in jail not Foley.

In 2006, an estimated 17,602 people died in alcohol-related traffic crashes—an average of one every 30 minutes. These deaths constitute 41 percent of the 42,642 total traffic fatalities. Of these, an estimated 13,470 involved a driver with an illegal BAC (.08 or greater). On average someone is killed by a drunk driver every 39 minutes. THIS IS THE REAL WORLD.

FOLEYS DRUNK IDIOT              

In his request for a search warrant to test Foley's blood for other substances, Nordell also listed previous encounters between Foley and police when he played for the Cincinnati Bengals in 1999 and 2000, and one in San Diego earlier this year. Foley pleaded guilty to a drunken driving charge in the 1999 incident and was exonerated or not charged in the other incidents . Foley was enrolled in an NFL alcohol-treatment program after his two arrests when he was with the Bengals.
