One of my law professors this past semester has a seat on the infractions committee, and someone in class just straight asked him one day why USC isnt getting hit for the Reggie Bush fiasco. His answer was basically this:
They know he took the money, they know that it is against NCAA rules, but the NCAA has no subpeona power, so they can not force the two guys involved to testify or give a deposition. However, if Reggie stops sending in gunmen to the depositions and the actual facts and evidence become public, then USC is screwed. It started out with two people that were involved, and Reggie paid one of them off and made him sign a confidentiality agreement to never discuss anything with the NCAA. However, it seems like the second person is not so easily paid to shut up, and when the lawsuit goes to court and the evidence becomes public, the NCAA has free reign to do what it pleases. I read somewhere the other day that a judge ordered Reggie to show up to a deposition, which he in the past has refused to come to and just sent his lawyers and armed goonies. Hopefully this guy wont get paid to be quiet and will actually release all his evidence so the NCAA can have a field day with it.
